Welcome to www.pet-awesome.com, the official website operated by EPACIFIC LLC (“Pet Awesome”, “we”, “us” or “our”). These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (the “User”, “you”, or “your”) and Pet Awesome, governing your access to and use of the website and any services (orders, purchases), features, or transactions made available through it. By accessing or using our website, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, please do not use the website.


1. ELIGIBILITY

 

Our website and products are intended for adults. We do not knowingly sell to children under 13, and minors between 13–18 may only use the website under supervision of a parent or legal guardian.


By using our website, you affirm that you are at least 18 years of age or the legal age of majority in your state of residence, whichever is greater. You must have the legal capacity to enter into binding agreements, including making purchases, creating an account, or providing personal information. 


If you are using the website on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.


2. ACCEPTANCE OF TERMS

 

These Terms apply to all users of the website, including but not limited to browsers, vendors, customers, merchants, affiliates, and contributors of content. 


Supplemental terms and conditions or documentation that may be posted on the website from time to time are hereby expressly incorporated by reference.


We reserve the right to modify these Terms at any time. Any changes will become effective immediately upon posting. It is your responsibility to review these Terms regularly. Continued use of the website after any changes indicates your acceptance of the updated version of the Terms.


3. ACCOUNT REGISTRATION AND SECURITY

 

To access certain features or make purchases, you may be required to create an account. When registering, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your password and account credentials.
  • If you detect any unauthorized use of your account or a security breach, notify us immediately.
  • Accept responsibility for all activity under your account.


We reserve the right to suspend or terminate accounts that are suspected of being fraudulent or in violation of these Terms.


4. PRODUCTS AND SERVICES


All products, bundles, accessories, and services made available on the website are listed for informational and commercial purposes only and are subject to availability, modification, or discontinuation at our sole discretion without prior notice. 


Products may be offered individually or as part of curated packages, subscriptions, or promotional deals, each of which may include specific terms and conditions. 


Pet Awesome makes reasonable efforts to maintain accurate and up-to-date product information, including pricing, availability, materials, dimensions, weight, color, and imagery. However, all such information is provided “as is” and does not constitute a binding representation, warranty, or guarantee. 


We disclaim responsibility for any errors, inaccuracies, or omissions that may arise from system issues, typographical mistakes, supplier data variations, or differences in photographic representation. Product listings, prices, and availability are subject to correction or change at any time without prior notice, and such discrepancies shall not constitute a binding offer.


We reserve the right to:

  • Add, remove, or modify products or services without prior notice.
  • Correct errors or inaccuracies in product listings.
  • Limit the availability of any product or service to any person, household, geographic region, or jurisdiction.
  • Refuse or cancel orders placed by customers who appear to be resellers, distributors, or competitors.


Certain products, such as hygiene accessories (e.g. Pee Pads), may have safety disclaimers and recommendations for proper use. Customers are encouraged to review product instructions, supervision guidelines, and storage requirements.


If a product received does not match the description or arrives defective, your sole and exclusive remedy is to initiate a return under our Returns and Refunds Policy.


5. ORDER ACCEPTANCE, BILLING, AND PAYMENT


By submitting an order, you authorize Pet Awesome to charge your payment method for the total amount, including taxes and shipping fees. We reserve the right to:

  • Refuse or cancel any order for any reason.
  • Limit or prohibit orders that appear to be placed by resellers, distributors, or unauthorized parties.
  • Contact you using the email or phone number provided if an issue arises with your order.


You agree to provide up-to-date billing and account information and to promptly update any changes.


In the event of a failed payment, declined transaction, or chargeback:

  • We may cancel your order and suspend or terminate your access to our services.
  • You remain responsible for any outstanding amounts owed.
  • We reserve the right to pursue collection efforts and may involve third-party agencies if necessary.


Pet Awesome is not liable for any delays or failures in order processing resulting from incomplete or inaccurate payment information.


6. SHIPPING AND DELIVERY


Pet Awesome currently ships to residential and business addresses across the United States. Upon placing an order, you will receive an estimated delivery date based on your shipping location, selected method, carrier availability, and processing time. These delivery dates are provided as estimates and are not guarantees.


Shipping and handling charges are calculated during checkout and may vary depending on package weight, delivery location, and delivery method. Orders may take 1-3 business days to process before shipping. During high-volume periods or due to supplier constraints, processing times may increase. 


You are solely responsible for ensuring that the shipping address entered at checkout is accurate and complete. We are not liable for:

  • Delivery delays caused by carriers, weather conditions, natural disasters, or customs delays.
  • Packages delivered to incorrect addresses due to customer input errors.
  • Risk of loss transfers once the order has been delivered to the shipping address you provided. If tracking shows “delivered” but you did not receive your order, please contact us within 7 days so we can assist with a carrier investigation and work toward a resolution.
  • Loss transfers upon handoff to carrier.

 

We do not currently offer international shipping, expedited weekend deliveries, or guaranteed overnight shipment services. Tracking information will be emailed to you once your order has shipped. 


In the event a package is returned to us due to non-delivery or refusal, you may be responsible for re-shipping fees unless otherwise determined by our support team.


7. RETURNS AND REFUNDS


At Pet Awesome, customer satisfaction is a priority. If you are not satisfied with your purchase, you may return most new, unopened items within 30 calendar days of delivery for a full refund, subject to the following terms:


Eligible returns must:

  • Be initiated by contacting our support team at support@pet-awesome.com or at our Contact Form on the website.
  • Include the original order number and reason for return.
  • Be shipped back using a traceable method with a return authorization label after receiving approval from our team.


Returned items must:

  • Be unused, undamaged, and in original, intact packaging.
  • Include all original accessories, labels, tags, and documentation.

 

Non-returnable items include (but are not limited to):

  • Used hygiene products such as Pee Pads, trays, or grooming accessories.
  • Items marked “Final Sale” or “Non-returnable”.
  • Gift cards, promotional items, or digital downloads.


Refund process: Refunds will be processed to your original payment method within 5-10 business days after we receive and inspect the returned items. We reserve the right to deny full or partial refunds if items are found to be used, damaged, or missing components.


Return shipping costs:

  • Customers are responsible for return shipping unless the product was defective or incorrectly shipped. 
  • If you are returning a defective item, we may issue a prepaid shipping label or refund shipping costs upon inspection.


If your order arrived damaged, please contact support within 72 hours of delivery and include photos to expedite resolution.


Restocking fees: Pet Awesome does not generally charge restocking fees. However, a restocking fee of up to 20% may be applied if items are returned without original packaging, show visible signs of use, or are missing accessories. Restocking fees will not apply to defective or mis-shipped items. 


Bundles and promotional items: If you purchased items as part of a bundle, promotion, or discount deal, partial returns may affect your refund. For example, if returning an item causes your order to fall below the promotional threshold, the discount may be deducted from your refund. Bonus or free items must also be returned (unused and in original packaging) to receive a full refund.


8. PROMOTIONS, DISCOUNTS, AND COUPONS


Pet Awesome occasionally offers limited-time promotions, discount codes, and other incentives to enhance the shopping experience. All promotions are governed by the Terms stated at the time of issuance and may be subject to specific eligibility criteria.


Promo codes:

  • Must be applied at checkout prior to order completion.
  • Are valid only for specified products or collections.
  • They do not have a cash value.
  • May not be combined with other promotions or applied retroactively (retroactive use is not permitted under any circumstances).
  • May be single-use or customer-specific and have an expiration date. Expired codes are void and will not be accepted.
  • Promo codes do not apply to subscription-based products unless explicitly stated.
  • The use of unauthorized third-party coupon codes not issued directly by Pet Awesome is strictly prohibited. 


Discounted or bonus items:

  • Must be returned if the original order is refunded.
  • May be forfeited if minimum order thresholds are not maintained.


We reserve the right to:

  • Modify or cancel promotions at any time without prior notice.
  • Decline redemption of codes suspected to be duplicated, misused, or obtained from unauthorized sources.
  • Limit redemptions to a single account, household, or IP address.
  • Promo codes do not apply to subscription-based products unless explicitly stated.


Technical issues with promo code applications must be reported to support@pet-awesome.com before the promotional period ends. We are not responsible for user error in entering code or missed opportunities after order submission.


9. USER-GENERATED CONTENT


You may submit content to the Site, including but not limited to reviews, comments, photos, videos, testimonials, or other materials (“User Content”). 


By submitting User Content, you grant Pet Awesome a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, modify, publish, translate, create derivative works from, distribute, publicly perform, and display such content in any media or format, for any lawful purpose, including but not limited to advertising, marketing, and promotional purposes.


You waive any moral rights or rights of attribution you may have in such content, to the extent permitted by law.


Pet Awesome reserves the right, but not the obligation, to monitor, edit, or remove User Content at its sole discretion. Pet Awesome expressly disclaims any responsibility or liability for User Content, including any illegal, infringing, defamatory, obscene, or otherwise harmful material, and shall not be held liable for any damages or harm arising from such content.

 

You are solely responsible for your User Content and represent and warrant that you own or have the necessary rights to submit the content, your content does not infringe or violate the rights of any third party, including intellectual property, privacy, or publicity rights, and your content is not defamatory, obscene, abusive, or otherwise unlawful.


Indemnification: You agree to indemnify, defend, and hold harmless Pet Awesome, its affiliates, officers, employees, agents, and partners from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees and defense costs) arising out of or related to your User Content, including any third-party claims alleging infringement of intellectual property rights, violation of privacy or publicity rights, defamation, or other unlawful conduct.

 

10. PROHIBITED ACTIVITIES


To protect the integrity, security, and lawful use of our website and services, the following activities are strictly prohibited. By using our Site, you agree not to:

  • Engage in unlawful, fraudulent, or deceptive activities.
  • Upload, transmit, or distribute viruses, malware, or any other harmful code.
  • Scrape, crawl, spider, or use other automated systems to extract data.
  • Send unsolicited or unauthorized advertising, promotional materials, or spam.
  • Attempt to gain unauthorized access to any part of the site, accounts, systems, or networks.
  • Interfere with the functionality, security, or integrity of our site or services.
  • Impersonate any person or entity, or misrepresent your affiliation with any party.
  • Collect or harvest personal information from users without their consent.
  • Infringe upon or violate the intellectual property or proprietary rights of Pet Awesome or others.

 

Violation of these terms may result in immediate suspension or termination of access, at our sole discretion, and may also lead to a civil or criminal liability.

 

We reserve the right to investigate suspected violations and fully cooperate with law enforcement authorities or regulatory bodies in such cases.


11. INTELLECTUAL PROPERTY


All content on the site, including trademarks, logos, images, graphics, and text, is the property of Pet Awesome (EPACIFIC LLC) or its licensors. Unauthorized use, reproduction, or distribution is strictly prohibited.


Any unauthorized use may result in legal actions against the user.


12. DISCLAIMER OF WARRANTIES


To the fullest extent permitted by law, the website and all content, products, and services made available through it are provided on an “as is” and “as available” basis, without any representations or warranties of any kind, whether express, implied, or statutory. 


Without limiting the foregoing, Pet Awesome expressly disclaims any and all warranties, including but not limited to: 

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement. 
  • Warranties regarding uninterrupted, timely, secure, or error-free access to the website.
  • Warranties that product descriptions, images, pricing, or availability are accurate, complete, reliable, or up to date. 
  • Warranties concerning the performance, quality, or reliability of any products, services, or third-party content, applications, or links. 


You acknowledge and agree that your use of the website, including any third-party content, services, or links, is at your sole risk. Pet Awesome does not warrant that the website, its servers, or any communications sent from us are free of viruses or other harmful components.


Pet Awesome does not guarantee the continuous availability of any content, product, or service and assumes no obligation to update, modify, or maintain any material made available on the website.

 

13. LIMITATION OF LIABILITY


To the fullest extent permitted by applicable law, Pet Awesome (EPACIFIC LLC), its affiliates, officers, employees, and agents shall not be liable for any damages of any kind, whether arising in contract, tort (including negligence), strict liability, statutory claims, or otherwise, including but not limited to: 

  • Indirect, incidental, punitive, exemplary, or consequential damages. 
  • Loss of profits, revenue, goodwill, or data. 
  • Personal injury or property damage allegedly arising out of or related to the use of the website, products, or services. 
  • Any damages or losses resulting from reliance on information provided on the website. 
  • Any damages arising from the use of, or inability to use, third-party products, applications, content, or services linked to or integrated with our website. 


This limitation applies even if Pet Awesome has been advised of the possibility of such damages. 


In any event, Pet Awesome’s total liability for any claim arising out of or relating to a product, service, or your use of the website shall not exceed the total amount actually paid by you for the specific product or service giving rise to the claim. 


Some jurisdictions do not allow limitations on implied warranties or the exclusion/limitation of certain damages. In such jurisdictions, some of the above disclaimers and limitations may not apply to you, but our liability shall be limited to the maximum extent permitted by law.

 

14. INDEMNIFICATION


You agree to indemnify, defend and hold harmless Pet Awesome and its affiliates, employees, and partners from any claims, damages, or liabilities arising from:

  • Your use of the website or products.
  • Your violation of these Terms.
  • Your infringement of third-party rights.
  • Any law or regulation violations.


15. DISPUTE RESOLUTION AND ARBITRATION


In the interest of resolving disputes amicably and efficiently, you and Pet Awesome agree that any dispute or claims arising from these Terms, your use of the website, or any purchase made through www.pet-awesome.com shall be resolved through binding individual arbitration as described herein. By agreeing to these Terms, you acknowledge and agree that you are knowingly and voluntarily waiving your right to file a lawsuit in court or have a jury trial, except as provided under the injunctive relief carve-out below.


Pre-arbitration resolution: You may opt out of this arbitration agreement by sending written notice to support@pet-awesome.com within 30 days of your first use of the website or your first purchase, whichever occurs earlier. If you opt out, you will retain your right to bring disputes in court.

 

Notwithstanding the foregoing, you may bring an individual action in small claims court if your claim qualifies.


Arbitration process: If resolution is not achieved, the dispute will be referred to the American Arbitration Association (AAA) and conducted under its Consumer Arbitration Rules. The arbitration may be conducted in person, by phone, via video conference, or by submission of documents, as mutually agreed. The arbitrator shall have exclusive jurisdiction to resolve any dispute related to the interpretation or enforcement of these Terms.


Waiver of class actions and jury trial: Notwithstanding the foregoing, either party may bring an action in a court of competent jurisdiction solely for the purpose of seeking injunctive or other equitable relief related to the protection of its intellectual property rights, confidential information, or proprietary data.

 

Location and governing law: Unless otherwise agreed, arbitration will be held in your county of residence or another mutually agreed location. These Terms and any arbitration shall be governed by the laws of the State of California.


The arbitrator’s decision shall be final, binding, and enforceable in any court of competent jurisdiction.


Fees and expenses: Pet Awesome will cover all filing and administrative fees for claims totaling less than $10,000 unless the arbitrator determines the claim is frivolous or brought in bad faith. For claims above $10,000, AAA rules will determine allocation of fees.


This arbitration agreement survives the termination of these Terms and your use of the website.


Force Majeure: Pet Awesome shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, government action, labor disputes, supply chain disruptions, or internet outages.


16. GOVERNING LAW


These Terms shall be governed by the laws of the State of California without regard to conflict of law principles. Any legal action that is not subject to arbitration shall be brought in the courts of California.


For non-U.S. customers, we do not guarantee any compliance with the laws applicable to the country where the order has been entered from.


17. SEVERABILITY


If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. 

To the maximum extent permitted by law, the unenforceable provision shall be modified or replaced with a valid provision that most closely reflects the original intent and economic effect.


18. ENTIRE AGREEMENT


These Terms, along with our Privacy Policy and any posted policies or rules, constitute the entire agreement between you and Pet Awesome and supersede all prior agreements.


They supersede all prior or contemporaneous communications and proposals, whether oral, written, or electronic, between you and us with respect to the Site or any products or services provided.


No oral statement or prior written communications shall modify or add to these Terms unless agreed to in writing by an authorized representative of Pet Awesome.
